Welcome to ProCuddleTherapy. These Terms of Service ("Terms") govern your use of our platform and services. By using ProCuddleTherapy, you agree to these Terms.

1. Acceptance of Terms

By accessing or using ProCuddleTherapy, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our platform.

2. Eligibility

You must be at least 18 years old to use ProCuddleTherapy
You must provide accurate and complete registration information
You are responsible for maintaining the security of your account
You may not use the platform if you have been previously banned

3. Platform Description

ProCuddleTherapy is a virtual companionship platform that connects subscribers with companions who provide nightly wind-down audio, weekly live sessions, and supportive chat. Our service is designed to help you sleep better and feel less alone. All interactions occur virtually through our platform.

4. Service Guidelines

All services on this platform are supportive and platonic in nature. Companions provide emotional support, calming audio content, and friendly conversation. Any inappropriate behavior, harassment, or solicitation of inappropriate services is strictly prohibited and will result in immediate removal from the platform.

5. User Accounts

5.1 Account Types

Subscriber Accounts: For individuals seeking virtual companionship services
Companion Accounts: For individuals providing audio, live sessions, and chat support

5.2 User Responsibilities

Users must provide accurate information, maintain respectful communication, and adhere to all community guidelines and boundaries.

5.3 Companion Requirements

Companions must:

Complete identity verification
Maintain accurate profile information
Publish nightly audio content consistently
Host weekly live sessions as scheduled
Respond to subscriber messages within 24-48 hours
Adhere to professional conduct standards
Comply with all applicable laws and regulations

6. Verification Requirements

6.1 Companion Verification (Required)

All companions must complete identity verification before being permitted to publish content or communicate with subscribers. The platform reserves the right to deny or revoke companion status based on verification findings.

6.2 Subscriber Verification (Optional)

Subscribers may optionally complete verification to receive a "Verified" badge. This verification is not required to use the platform or subscribe to companions.

7. Subscriptions and Payments

7.1 Subscription Tiers

ProCuddleTherapy offers four subscription tiers:

Starter ($39/mo): Nightly wind-down audio
Core ($79/mo): Audio + weekly live sessions
Plus ($119/mo): Core features + AI chat + 5 companion messages/month
Premium ($249/mo): Plus features + unlimited companion chat with same-day responses

7.2 Billing and Renewal

Subscriptions are billed monthly and automatically renew until cancelled
You will be charged on the same date each month as your initial subscription
Upgrade charges are prorated; downgrades take effect at the next billing cycle
All payments are processed through Stripe

7.3 Cancellation and Refunds

You may cancel your subscription at any time from your dashboard
Cancelled subscriptions remain active until the end of the current billing period
New subscribers may request a full refund within 7 days of their first charge
Refunds after the 7-day period are at our discretion and will be considered on a case-by-case basis

7.4 Companion Payments

Companions receive 82% of subscription revenue
ProCuddleTherapy retains an 18% platform fee
Payouts are processed weekly on Sundays
Minimum payout threshold is $50
Payments are sent to the cryptocurrency wallet on file

8. Code of Conduct

8.1 General Conduct

All users must:

Treat others with respect and dignity
Communicate honestly and transparently
Respect boundaries at all times
Report any safety concerns immediately

8.2 Prohibited Activities

You may not:

Harass, threaten, or abuse other users
Share inappropriate, explicit, or offensive content
Provide false or misleading information
Use the platform for illegal activities
Attempt to contact companions outside the platform
Share or redistribute companion audio or content
Scrape or harvest user data
Impersonate others or misrepresent your identity
Share account credentials with others

8.3 Content Guidelines

All audio content must be original and appropriate
Live sessions must be conducted professionally
Chat conversations must remain respectful and supportive
Either party may end a conversation or session at any time for any reason

9. Privacy and Safety

9.1 Data Protection

ProCuddleTherapy protects your privacy:

All data is encrypted in transit and at rest
Companions only see subscriber display names, never real names or contact info
We never sell or share your personal information with third parties

9.2 Reporting Concerns

If you experience inappropriate behavior, harassment, or have safety concerns, report the issue immediately through our Report feature or by contacting support. We investigate all reports within 24 hours.

10. Intellectual Property

ProCuddleTherapy retains all rights to the platform, branding, and content we create
Companions retain rights to their audio content but grant us a license to distribute it to subscribers
Subscribers may not copy, share, or redistribute companion content
You may not copy, modify, or distribute our platform without permission

11. Disclaimers

11.1 Platform Role

ProCuddleTherapy is a platform for virtual companionship. We are not:

An employer of companions
A healthcare provider or mental health service
A substitute for professional therapy or medical care
Responsible for the conduct of individual users

11.2 No Warranties

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

Uninterrupted or error-free service
The quality of content provided by companions
The accuracy of user-provided information
That the platform will meet your specific needs

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROCUDDLETHERAPY SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, or goodwill
Actions or conduct of other users
Any amount exceeding the fees paid to us in the past 12 months

13. Indemnification

You agree to indemnify and hold harmless ProCuddleTherapy, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

Your use of the platform
Your violation of these Terms
Your violation of any rights of another party
Content you create or share through the platform

14. Account Termination

You may delete your account at any time through account settings
We may suspend or terminate accounts for Terms violations
We may terminate the platform or any features at any time
Upon termination, your right to use the platform ends immediately
Active subscriptions will not be refunded upon account termination for Terms violations

15. Dispute Resolution

15.1 User Disputes

Disputes between subscribers and companions should first be resolved through our support team. ProCuddleTherapy may mediate disputes at our discretion but is not obligated to do so.

15.2 Disputes with ProCuddleTherapy

Any disputes with ProCuddleTherapy shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class actions.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
